Fair Use Policy
Last Updated: October 2024
1. Purpose
IPM-EMS (Integrated Pre-Hospital Medicine) is committed to supporting education, professional development, knowledge sharing, and the responsible exchange of information for pre-hospital medicine professionals including Paramedics and EMTs.
For the purposes of this policy, fair use means that other people or organizations may, in appropriate circumstances, use material without first acquiring permission from the rights holder when the use can reasonably be justified as serving the public interest or having legitimate news, educational, research, commentary, or similar value.
Fair use also applies to the material that IPM-EMS chooses to access, reference, quote, display, or share. We expect our users to respect the intellectual property rights of others, and we hold ourselves to the same principle.
2. Permitted Use of the Platform
Unless otherwise stated, content and materials published on the IPM-EMS platform may be protected by copyright or other intellectual property rights.
Limited use of IPM-EMS material may be appropriate for purposes such as:
- Education and training
- Research and scholarship
- Professional development and continuing education
- News reporting
- Commentary or criticism
- Internal agency or organizational training
- Other legally recognized fair-use purposes
When using IPM-EMS material under fair use, users should:
- Use only what is reasonably necessary for the intended purpose.
- Provide appropriate attribution to IPM-EMS and, where applicable, the original author or creator.
- Avoid presenting IPM-EMS material as their own work.
- Avoid altering material in a way that misrepresents its original meaning or context.
- Consider whether the proposed use could improperly substitute for, reproduce, or commercially exploit the original material.
- Obtain permission when the intended use extends beyond what applicable law permits without authorization.
3. Restrictions on Unauthorized Access or Data Misuse
Access to the IPM-EMS platform is granted exclusively to authorized members for legitimate educational and professional development purposes. Unauthorized access, use, or misuse of the platform, accounts, courses, data, or materials is prohibited.
Users must not:
- Attempt to gain unauthorized access to any accounts, courses, administrative areas, or data on the platform.
- Copy, download, reproduce, distribute, modify, republish, sell, or commercially exploit any course content, quizzes, assessments, certificates, progress records, or other materials without explicit authorization.
- Use bots, scrapers, crawlers, or other automated means to access or extract data from the platform.
- Share account credentials or allow any third party to access the platform using your account.
- Misuse or mishandle any user data, training records, or personal information obtained through the platform.
- Interfere with the security, integrity, or performance of the platform.
4. User Responsibilities
Users are responsible for using the platform in a lawful, ethical, and professional manner. By using IPM-EMS, you agree to:
- Maintain the confidentiality of your login credentials and protect your account from unauthorized access.
- Provide accurate registration information and keep your profile details up to date.
- Use the educational content responsibly and understand that it supplements but does not replace hands-on clinical training, supervision, or professional judgment.
- Comply with all applicable laws, regulations, and the standards of your certifying or licensing bodies.
- Report any suspected security issues, policy violations, or unauthorized use promptly.
- Accept responsibility for all activity that occurs under your account.
5. Limitations of Liability
The IPM-EMS platform, courses, tools, and materials are provided for educational and training purposes only. They are not a substitute for professional medical care, clinical experience, or compliance with local protocols and regulations.
To the maximum extent permitted by applicable law, IPM-EMS, its operators, affiliates, and content providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or personal injury, arising from or related to:
- Your access to, use of, or inability to use the platform
- Any errors, inaccuracies, or omissions in the content
- Any reliance placed on the training materials or certificates
- Unauthorized access to or alteration of your data
- Any other matter relating to the platform
The platform is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied.
6. Educational and Training Use
IPM-EMS supports responsible use of its material for education and professional development of Paramedics, EMTs, and other pre-hospital care providers.
Educators, instructors, students, healthcare professionals, public-safety professionals, and other learners may quote or reference IPM-EMS material when the use is reasonable, properly attributed, and consistent with applicable law.
Where substantial portions of IPM-EMS courses, assessments, graphics, videos, training materials, downloadable resources, or other proprietary materials are to be reproduced or distributed, users should obtain permission unless the proposed use is otherwise permitted by law.
7. Attribution
Where appropriate, attribution should identify:
- IPM-EMS or Integrated Pre-Hospital Medicine
- The title or description of the material, if available
- The original author or creator, when identified
- A link to the original IPM-EMS page, when practical
Attribution does not, by itself, make an otherwise unauthorized use lawful.
8. Third-Party Rights
Some content appearing on the IPM-EMS platform may belong to third parties and may be used under permission, license, fair use, or another legal basis.
IPM-EMS cannot grant permission to use intellectual property owned by another person or organization. Users who wish to reuse third-party material should determine who owns the applicable rights and whether additional permission is required.
9. No Legal Advice
This Fair Use Policy describes IPM-EMS's general approach to the responsible use of the platform and sharing of content. It is not legal advice and does not determine whether a particular use qualifies as fair use, fair dealing, or another exception under applicable copyright law.
When there is uncertainty about whether a proposed use is permitted, users should seek permission from the rights holder or obtain appropriate legal advice.
